We collect personal information for the purposes of in processing your application for loan / financing through MHub, to facilitate the referrals of your loan / financing application to the relevant Credit Service Providers, and to administer the products and services that you have signed up for and to respond to your enquiries and complaints, and to resolve disputes, and to update your loan / financing applications status via MHub. If you do not provide us with all the information we request, we may not be able to deliver our services.

Trademarks

The trademarks and logos displayed on the Site are the registered and unregistered trademarks of their respective owners. Use of the trade marks displayed is strictly prohibited. You are advised that the owners of the trade marks will aggressively enforce their intellectual property rights to the fullest extent of the law, including seeking criminal prosecution.

The Site is only for illustration purposes and perusal of information. Everything on the Site is provided on an “as is” basis without any representation, endorsement or warranty of any kind, either express or implied, including, but not limited to, warranties of title, merchantability or fitness for a particular purpose or non-infringement. Reliance on the materials is at the user’s own risk.

The Site may link to other third-party Internet sites. Those third party websites do not form part of our platform and are not under the control of or the responsibility of TRB. When you link to those websites you leave our platform and do so entirely at your own risk. TRB and its related entities make no warranty as to the accuracy or reliability of the information contained on any third party websites, and TRB and its related entities, directors, officers and agents disclaim all liability and responsibility for any direct or indirect loss or damage which may be suffered by you through relying on anything contained on or omitted from such third party websites. A display of advertising does not imply an endorsement or recommendation by TRB.

TRB does not endorse, support, sponsor, represent, warrant or guarantee any product, service, opinion, comment, recommendation, description, suggestion, advice, consultation or information given, offered, hired, exchanged, traded, sold, advertised, announced or implied by any of the external sites, establishments, organisation or entities listed on this Site.

Further Warranty

You represent and warrant that:

• your use of our platform will comply at all times with these terms and any directions we make to you in relation to your use of our platform from time to time;
• if applicable, you will make sure that you keep your username and password by which you access the Site confidential and secure at all times; and
• if applicable, you accept all liability for any unauthorised use of any username and password issued except for unauthorised use resulting from any negligent act or omission legally attributable to TRB.

Indemnity

You agree that your use of the Site is at your sole risk and that you are responsible for all costs associated with your access to, or use of, the Site. TRB, its directors, employees or any other representative will not be liable for any damages, losses, costs, claims or demands of any kind, whether direct, indirect, compensatory or consequential, related to your use of this Site or the information content, materials or products included on this Site. These terms are governed by Malaysia law and any dispute will be resolved exclusively by the Malaysian courts.

Limitation of Liability

Subject to the above, TRB excludes all other liability to you for any costs, expenses, losses and damages suffered or incurred by you in connection with your use of the Site, whether that liability arises in contract, tort (including by our negligence) or under statute. Without limitation, TRB will not, in any circumstance, be liable for any indirect or consequential losses, including loss of profits, loss of revenue and loss of business opportunity.

Access to and updates of information

‍Users may request at any time to see the personal information that TRB / MHub holds on its behalf or to correct or update any personal information (to the extent that Users are unable to do so on the Website). If you wish to obtain a copy of your Personal Data, please contact support@mhub.my.

No Warranty

‍While TRB strives to keep information on the Site accurate and current, materials may contain inaccuracies and typographical errors. TRB does not guarantee or warrant the accuracy, completeness or timeliness of the information displayed on the Site. TRB reserves the right, in its sole discretion to correct any errors or omissions in any portion on the Site and make any changes at any time without notice.

Also, please note that we may store and process your personal information in systems located outside of your home country. However, regardless of where storage and processing may occur, we take appropriate steps to ensure that your information is protected, consistent with the principles set forth under this Policy.

PDPA Consent

By using the DSR calculator on the Site you hereby agree that TRB may collect, obtain, store and process your personal data that you provide to TRB and/or through the MHUB platform.

You hereby give your consent to TRB to:-

Store and process your Personal Data;

Disclose your Personal Data to the relevant governmental authorities or third parties where required by law or for legal purposes

In addition, your personal data may be transferred to any company related to and/or associated with TRB which may involve sending your data to a location outside Malaysia. For the purpose of updating or correcting such data, you may at any time apply to TRB to have access to your personal data which are stored by TRB.

For the avoidance of doubt, Personal Data includes all data defined within the Personal Data Protection Act 2010 including all data you had disclosed to TRB in this Form.

Under the Personal Data Protection Act (PDPA) 2010, we are required to obtain your explicit consent when we collect and process your sensitive personal data. We collect your sensitive personal data in order to assess your application for financing through the MHub platform and to administer the products and services that you have signed up for and to respond to your enquiries and complaints, and to resolve disputes, and to update your loan applications status via MHub.

Declaration

I am declaring that I have read, understood and agreed to the terms of the TRB Venture Sdn Bhd’s Privacy Policy and by the use of the MHub DSR Calculator I am expressly consenting to and authorising TRB to collect, hold, use, delete, disclose, transfer, administer, store and process in any other way, all my personal data (including sensitive personal data and personal data of other party provided by me) (hereinafter referred to as “Personal Data”) given now or that is subsequently obtained from time to time, which may include but not limited to:-

• Name;
• National registration identity card number / Passport Number;
• Gender;
• Postal address;
• Telephone number;
• Email address;
• Preferred service provider/personnel;
• Required estimated loan; and
• Contact preference

for the purposes below. I understand that if I do not provide the Personal Data requested, TRB will not be able to carry out the purposes below:-

To process and/or forward my application for loan / financing and all other necessary transaction which are required in relation to any products and services offered by TRB.

To efficiently link you up with a credit service provider and keep me updated on the latest status of my loan / financing applications

To send important notices, emails, letters or sms, like communicating your loan applications and changes to TRB’s terms, conditions, and policies.

To use my Personal Data for purposes such as auditing, data analysis, and research to improve TRB’s products, services and customer communications.

To share my Personal Data with third party providers that provide services such as information processing, extending credit, fulfilling customer orders, delivering products to me, managing and enhancing customer data, providing customer service, assessing my interest in TRB’s products and services and conducting customer research or satisfaction surveys.

To respond to my inquiries and complaints and to resolve disputes.

For any purpose required by law or regulations.

I further confirm that all personal data (including sensitive personal data) that I have provided are all true, up-to-date and accurate. Should there be any changes to any of my personal data, I shall notify TRB immediately.

I understand that in order for TRB / MHub to provide me updates on the status of my loan / financing application, the relevant Credit Service Providers must provide information on the progress of my loan / financing application to TRB / MHub.

I hereby expressly authorise any Credit Service Provider to whom I have made a loan / financing application through MHub to provide the information required by TRB / MHub so as to enable them to update me on the status of the loan / financing application I have the right to access and correct my personal data if it is inaccurate or to delete the data if TRB is not required to retain it by law or for legitimate business purposes.

I understand that depending on the information requested, TRB may have the right to charge a small fee for the processing of any data requested. TRB may also take steps to verify my identity before fulfilling my request for access to my personal data.

TRB may decline to process requests that are unreasonably repetitive, require disproportionate technical effort; jeopardize the privacy of others, extremely impractical, or for which access is not otherwise required by local law I understand that TRB will take the necessary precautions, both administrative and technical to safeguard my Personal Data against loss, theft, misuse and unauthorized access, disclosure, usage, alternation or destruction but TRB cannot guarantee that unauthorized persons will always be unable to defeat the security measures implemented.

Amendments to these Terms of Use

These Terms of Use may be changed by TRB at any time without notice, and you are responsible for regularly reviewing these Terms of Use. Your continued use of the Site after the effective date of such changes will constitute acceptance of and agreement to any such changes. If you object to any such changes, your sole recourse is to stop using the Site. Any material changes will be posted on our website with the updated Privacy Policy.
